[Massplanners] Section 81W "Petition" Submitted by Third Party

Hello Mr. Robbins,

I've had my share of MGL Ch 81W plans, but never by a third party. I was
just curious, how would they even go about obtaining the signature of the
property owner and all of the mortgagees on the application? That's been a
lift for the developer who has returned to the Planning Board with an 81W, I
can't imagine where the third party would even begin (particularly given
your example of the abutter seeking to have the approval rescinded or
modified). Why would the land owner and/or mortgagees contemplate signing
the application?  Just curious.

Have any of your boards been faced with a Section 81W petition to modify,
amend or rescind a subdivision approval where that petition was submitted by
a third party (an example would be an abutter seeking to have the approval
rescinded or modified)?

 

If so, how has the board dealt with such a petition?

 

(This would not be an appeal of the approval; it would be an attempt to
alter the approval after the appeal period has lapsed, and quite possibly
after construction is well underway.)
