[Massplanners] Sight Distance Easement

Good afternoon,
We have a Definitive Plan on the horizon where the sight line out of the proposed road would be obstructed by an abutting property owners fence and arborvitae, therefore requiring a sight distance easement. The abutter does not approve of the project and has told the developer that he will not grant the easement. (For a variety of reasons, the layout/placement of the proposed road can't be changed.) Historically the Planning Board has required the easements be submitted prior to approval of the Definitive Plan. Has anyone been in a similar situation and, if so, how was it resolved?
