[Massplanners] ADU's - condo-ing

In the scenario described below, the ADU is not “accessory” as defined by regulations.
Do not believe that the ADU can become a condominium unit.

From where I sit:

Given a single parcel -
Given two approved dwellings -
Given a sale of the entire property to a condominium association -

I think that the association has the right to establish a condo association, and sell the separate dwellings to separate persons.
I think that the AG would not approve a Zoning Bylaws attempting to regulate the ownership of a private dwelling.

That being said -
A town would likely earn more tax revenue if the two structures were held in separate ownership - each would become principal
if both structures are served by the same septic system or well, there are health regulations that would likely kick in like an addled mule.

Just some thoughts.

Maybe this is a Friday question. Certainly not any other day question.

Still waiting for any intelligent insight?

I have received several conflicting responses……big surprise!

Can anyone provide insight into this?

Any formal / official input from HLC?

Thanks

Good morning and happy Friday.

Do the ADU regulations speak to condo-ing ?

I see specific mention of rental, but not ownership.

Thanks
