I would assume that if the unit has been conveyed to a homeowner at that point and time the deed rider and the regulatory agreement are in place in addition to the condo docs. What type of change are they looking to make? Lynne

 Hi,

Does anyone have experience with homeowner requested modification of a Comprehensive Permit after the developer has completed the project and fulfilled all other post-development obligations?

Does your town handle this as a modification to the approved plans and follow 760 CMR 56.00 regulations or is there another way that you address this? Do you have a written process?

Is anyone aware of caselaw relating to HOA/COA attempts to modify a Comprehensive Permit?

Thanks for any information you might have to share.
