The rules and regulations of the Permit Granting Authority (PGA) must establish the procedure for retaining outside consultant for review of projects. If this involves an application under subdivision control law, then there should be separate provisions in the subdivision rules and regulations as well.

There cannot be a presumption that every application will be reviewed by outside consultant(s). This should be discussed by the Board at the public hearing.

  1.  Is the consultant selection by a planning board subject to state or local contract/bidding requirements?
  2.  May the consultant be engaged by planning board to assist prior to an actual permit submission (e.g., to work with PB and applicant to advise on pre-application designs)?
