I’m probably coming in late on this, and I didn’t go through the enacted law line by line, but I noticed it in a prior draft – isn’t HLC supposed to issue regs for this new law (similar to MBTA)?  If so, even though it says it goes into effect in February, without the regs wouldn’t it be paused until those are final?  And one would think the state would have understood that the effective date precedes most community's Town Meeting season.  I suspect the antis will have a field day if we are expected to call a special town meeting over the holidays to deal with this.  Seems like poor, ahem, planning.

An advisory note from a New Bedford law firm, Mead, Talerman & Costa, LLC, says "The portion of the Act pertaining to ADUs is effective in 180 days, i.e. on February 2, 2025, so there is an opportunity to consider zoning changes before these changes become effective."

Hello MassPlanners,



Can anyone confirm if the ADU legislation in the Housing Bond Bill takes effect in February 2025 or if it is in effect upon the Governor’s signing? I am seeing that Section 143 of the law (Chapter 150 of the Acts of 2024) states that Section 8 (which amends c. 40A §3 to allow ADU by right) “shall take effect 180 days after the effective date of this act.”



I know that Section 7, the definition of “Accessory dwelling unit,” takes effect immediately.
