Hi Laura

Harvard had recently added the following:

“B. <https://ecode360.com/37677439#37677439> Limitations. The special permit and/or building permit shall be issued only if the application contains the following limitations and conditions:

(1) <https://ecode360.com/37677440#37677440> The owner(s) shall continue to reside on the property as their principal residence.”

Which doesn’t provide clarity for you…I tried to have the Board go further and eliminate the owner occupancy requirement, but they did not want to do that yet.

Good book on ADU which includes barriers to succeeding in development is called Backdoor Revolution: The Definitive Guide to ADU Development. In it the author notes that the owner occupancy requirement restricts valuations and the ability to get financing to build.

Good evening Massplanners,
It would be great to hear about either or both of the following:

If you have an ADU bylaw where one of the units must be owner occupied, how do you define "occupied"? Is there a specific time period stipulated that the owner must live on the property...or  do you sort of set it and forget it?

Do you have language to prevent ADU's from being used as short term rental units?
