Jeff:

The bylaw Marilyn cited is from my town of Shutesbury’s Natural Resource Protection Zoning bylaw. It’s been adopted in a number of other towns as well. Please contact me if you’d like further details.

I suggest taking a look at Shutesbury’s Open Space Design bylaw (see Article V): https://www.shutesbury.org/sites/default/files/files-and-images/Bylaws/ZoningBylaw_amended2021.pdf . Sec. 5.3-3 describes density bonuses, including one for allowing deeded public access to the open space.

I’m looking for examples of zoning language that provides incentives (density or otherwise) for provision of publicly accessible open space at a development. Ideally, I’m looking for waterfront examples but I’m also interested in any ways communities have tried to use bonuses of some sort to get more public access to open space.

Any examples that are relevant would be welcome.
