A lapse in time between the endorsement and the eventual recording an ANR plan should not matter to a Registry of Deeds.  The lapse only matters in the case of an 'approval' required, i.e. subdivision, plan.  See following language from 81X, with emphasis added: "... and, unless, IN CASE OF PLANS APPROVED, the endorsement or certificate is dated within six months of the date of the recording, or there is also endorsed thereon or recorded therewith and referred to thereon a certificate of the planning board or city or town clerk, dated within thirty days of the recording, that the approval has not been modified, amended or rescinded, nor the plan changed...."

Can anyone provide a scope of work or recent RFP for a "highest and best use" study as well as provide a recommendation on firms that could undertake such work?  We are in the early stages of looking at redevelopment of a  large industrial property in town.

Good Evening Planners
Does anyone have a template for a bit of an odd ANR issue? We have a local land trust that had an ANR plan signed 2 years ago in December 2020 to facilitate a CR closing. This closing was significantly delayed. They are looking to do the closing now. Does anyone have a template for a certificate to attached to the old ANR certifying no change has occurred in the intervening time as referenced in Ch. 41 - 81X to attach to such a plan for recordation? Just checking to ensure we can produce something that has previously been accepted by another MA Registry. A call to our own Registry was unfortunately not helpful.

I?ve attached an image of an 81-X certification below.  The developer did make minor changes in how the subdivision was phased, which is also noted.  You can just delete the last sentence.

Greetings -

I am the Planning Board chairperson in New Marlborough.  Our Select Board has asked our Planning Board for guidance in defining short-term rentals for the purpose of proposing a lodging tax that would be voted on by the community at the next Annual Meeting.  The Planning Board is also considering whether short-term rentals should be subject to some reasonable fire/life/safety bylaws consistent with other lodging uses (e.g. motels,
B&B's) which we do not currently have.

I am reaching out to see if other communities have adopted similar regulations so we can evaluate what might be appropriate for our community.  Any information that could be passed along (bylaw language regarding short-term rental definitions, taxation policy, fire/life/safety regulation, etc.) would be greatly appreciated.
