I was (on a part-time basis), the Interim Land Use Director for Lunenburg<br>
for the past 10-1/2 months. Their Planning Board does meetings on a Hybrid<br>
basis - Zoom, in person, and on the access channel. It can be a challenge -<br>
participating in the meeting while also keeping track of the Zoom waiting<br>
room for raised hands and sharing of materials. They also had some issues<br>
with their Zoom link as posted on the agenda not being correct - the<br>
Planning Board could have met in those instances but they felt it was<br>
unfair to meet when some people may have chosen to stay home and<br>
participate via Zoom.<br>

If you would like to talk about my experience with the hybrid in Lunenburg,<br>
I would be happy to talk with you further.<br>

I think it can work very well but does take some additional administrative<br>
work.<br>

We've gotten into a good groove with hybrid meetings. Our higher profile boards (Select Board, Planning Board, Warrant Committee, School Committee) use the Zoom Webinar product. This allows a good measure of control over remote meeting participants; unless
you're designated as a panelist or explicitly enabled to speak, you're a view-only participant (no camera, no mic).<br>
<br>
Each of our conference rooms is outfitted with a large video screen. Materials are presented through the Share Screen function on Zoom; either staff or applicants will bring up materials on their laptop and share it on Zoom, which is also on the large presentation
screen in the room.<br>
<br>
When there's an opportunity for public comment, we ask remote participants to use the Raise Hand function, which creates a queue in the Participants list. Staff usually monitors this, while the chair keeps an eye on in-person participants who want to speak.<br>
<br>
Our local access television team handles the recording and live-streaming of meetings.<br>

I'm speculating a bit, but I imagine that CBO's applying to all developments might be interpreted as a form of Impact Fee. In Massachusetts, Impact Fees have generally required a home rule petition and legislative approval. In Barnstable County, the Cape Cod
Commission Act permits Impact Fees for communities with Local Comprehensive Plans.<br>

It might be possible to thread the needle here via site plan or special permit criteria.<br>

I have a legal question regarding implementation of Community Benefits Ordinances (CBOs). Every CBO that I have come across specifies that the municipality can require a benefits agreement through its CBO bylaw if the developer is seeking a financial incentive
from that municipality. However, we were recently asked if it would be possible to legally enforce a CBO bylaw that requires any developer meeting a certain threshold to provide CBO benefits, regardless of whether they need financial assistance.<br>

My question is this: Is it legal to have a CBO apply to all development (with some financial thresholds) and not just to developers who ask for financial assistance in the form of tax breaks, etc.? Does this run into any issues related to notions of ?nexus?
and ?rough proportionality? as understood from the Nollan/Dolan cases? And do you know of any examples of this working in practice?<br>

I am hoping to report on production numbers -- permitting of new<br>
multi-family buildings under zoning adopted for compliance with MBTA<br>
Communities law. Let me know if projects are coming through your community.<br>

So far I have found the following (but please correct this if any numbers<br>
are off):<br>

*Somerville<br>

Received 12 applications for construction of new three-unit buildings, and<br>
11 applications to add one or two units to an existing single-family or<br>
two-family.<br>

*Bedford*: Two projects are in the works: one to replace an existing<br>
two-family with a 4-unit building, another to build a 7-unit building in<br>
place of a single-family.<br>
<br>
<br>
<br>
*Lexington: *One source reported to me 1,164 units somewhere in the<br>
pipeline. This article<br>

Norfolk received AG approval for our MBTA zoning. Just waiting to hear back<br>
from HLC if they give us approval we have a developer ready to permit 14<br>
units next to Norfolk Train Station.<br>

Congratulations to Cambridge on a century of zoning! This year is also the centenary (of the print publication) for the Standard State Zoning Enabling Act at the federal level, a critical milestone in the evolution of planning practice. We can moreover look
forward to similarly reflecting on Euclid v. Ambler Realty in two years and the Standard City Planning Enabling Act in another year or two after that. Regardless of their complicated long-term legacies, those innovations in regulating land use represented
a major expansion of the planner's toolkit.<br>
