advised that they file a letter with the Registry simply stating that they are “abandoning the approvals found in the Special Permit granted on _____ by the Dennis Planning (or Zoning) Board under Permit # ___” . This way the abandonment is on record and
a future buyer will know that they can not rely upon the rights in the recorded permit.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:11.0pt">We would treat the change of use as willful abandonment as soon as the new use is established on the property. Willful abandonment does not require two years to elapse. We have also, in the Site Plan Approval
(approve/approve with conditions) required the applicant to record an abandonment notice at the Registry before the issuance of the Certificate of Occupancy or other device that might be needed from the Building Commissioner to open the new business.<o:p></o:p></span></p>

repair and motor vehicle sales – the lot was previously vacant. The property owner developed the lot in accordance with these approvals.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:11.0pt">Now fast forward about 6 years later and the property is set to change ownership. The new owner is proposing a new use that is allowed by right in the district (retail sales to the general public). The proposal
does not feature any additions to the building nor any changes to the parking lot. The change of use will trigger Site Plan Review with the Planning Board.
