Hello Pamela,
We had an applicant request a withdrawal with prejudice a few years ago.
It was a proposed subdivision. I believe it prevents a repetitive petition
within 2 years. Not really sure how it works because it was the withdrawal
with prejudice for a subdivision.
I don’t think it matters but the developer got a PEL for a 40B project.

*Subject:* [Massplanners] Withdrawl with prejudice
Hello, I have an advertised hearing noticed to abutters etc. and the
applicant has requested to withdraw with prejudice. Has anyone experienced
this before?. I assume it results in the prohibition of a repetitive
application but does it require a vote of the ZBA or a simple
acknowledgement of the written request at the meeting? Thank you.
