[Massplanners] Completed Subdivision -Street Acceptance

Good Morning Planners:

Here in Northbridge we have a "finished subdivision" -where all roadways & associated improvements (water/sewer/etc.) have been completed, with 4 of 5 roads accepted as public ways.

The Developer has delayed acceptance of the remaining roadway (second means of access/egress) -as he feels maintaining responsibility of the remaining subdivision roadway allows him to retain control of the sewer & thereby select how/when "his private sewer line" is extended into the adjacent public way, where other properties may tie-in, extend & utilize (this public sewer service).

Perhaps not necessary a bad thing, in the sense of growth control -as neighboring properties are largely undeveloped and may yield upwards of 50 to 60 single-family house lots.

Of note, the Town has not received any inquiries or expressions of concern from abutting property owners with regard to their inability to extend sewer for potential developments. Residents within the subdivision may have questioned the roadway status & the Planning Board may become concerned when the subdivision roadway begins to deteriorate.

It is my understanding, the Planning Board may initiate calling-in the performance bond (deposit of money) for the purpose of street acceptance consideration -Yes/No?  Where monies held could be used to prepare necessary as-built & layout plans for Town Meeting.

If not the Developer, is the Town (Planning Board) obligated to take this to a Town Meeting?
