[Massplanners] MBTA Communities Guidelines - Revision

Dear Massplanners:



I am posting this to let folks know about a revision to the Compliance Guidelines for Multi-family Zoning Districts Under Section 3A of the Zoning Act released on August 10 (the "Guidelines"). This targeted and limited revision addresses the circumstances in which an inclusionary zoning requirement will be deemed in compliance with the law, to provide greater flexibility to MBTA communities committed to increasing multi-family housing production while meeting a local need for income-restricted units.  The Guideline revisions are effective as of today (October 21, 2022) and can be found here: https://www.mass.gov/info-details/multi-family-zoning-requirement-for-mbta-communities



In addition to the updated Guidelines you can also find a one page summary memorandum from DHCD Undersecretary Jennifer Maddox.
