[Massplanners] Earth Removal Bylaws

All - Kingston just updated its general bylaw regarding earth removal to require that applications for the final proposed development be submitted and issued in advance of requesting the earth removal permit - so that the planning/zoning boards can use the consulting review process to vet whether it is both necessary and incidental to remove the earth for the proposed use.  We added necessary (previously it was just incidental) to the allowed uses.  Please let me know if you want the bylaw itself, it is going through AG review.

Planners,

Douglas is looking to overhaul its Earth Removal bylaws, due to issues with subdivisions creating lots requiring massive cuts in excess of 300 cu yards in excess of what's incidental to foundations.  Do any cities and towns have earth removal bylaws that they're happy with and if so, could you please share?  Thank you!
