[Massplanners] Solar Array Storage Batteries

Dear Tony:Carver has one poorly written line in its use table regarding battery storage. Town Meeting recently voted a moratorium on battery storage after one project was permitted. I'll be working with a "to be created" Zoning Bylaw committee on new language although the Town is unlikely to see another due to the typical needs to locate such a facility near utility transmission lines. In Falmouth we met with a company considering a comparable project locating near high tension lines where the facility would charge batteries from the grid at night during off peak rates and sell back to the grid when demand and rates are higher.The project is going to the Energy Facilities Siting Board  (EFSB) on 7/12/22 since it is over 100MW. Due to the moratorium and Facebook the applicant who have both special permit and site plan approval are asking for a comprehensive zoning exemption. The project is described by EFSB below. A recording of the public comment hearing will be posted to the Department’s YouTube channel after the public comment hearing. Stay tuned

On August 27, 2021, Cranberry Point Energy Storage, LLC (“Cranberry Point” or the“Company”) filed a petition with the Energy Facilities Siting Board (“Siting Board”), pursuant toG.L. c. 164, § 69J¼, to construct a 150 megawatt (“MW”), 300 megawatt-hour (“MWh”), battery energystorage system and ancillary electrical equipment to be located on a six-acre parcel of land at 31R MainStreet, Carver, Massachusetts (the “Project”). Under G.L. c. 164, § 69J¼, the Siting Board will reviewthe Company’s filing to determine whether the proposed Project would contribute to a reliable energysupply with a minimum impact on the environment at the lowest possible cost. On May 11, 2022, theCompany filed a petition with the Department of Public Utilities (the “Department”), pursuant to G.L.c. 40A, §3 for a comprehensive exemption of the Zoning Bylaws for the Town of Carver (the “ZoningPetition”). The Siting Board will review the Zoning Petition to determine whether the zoning exemptionis required for the Project, and if the proposed use of the land or structure is reasonably necessary for theconvenience or welfare of the public. The Siting Board will review the two petitions in one proceeding.The Siting Board will conduct a second public comment hearing regarding the Project because of theZoning Petition.

I am looking for any towns that have created a bylaw for lithium-ion battery farms. The town has an application before it for one which
 
Would be adjacent to a residential area. I am wondering how/what other municipalities are doing to regulate the location and permit
 
Process. Chapter 40A Section 9B discusses Solar access, but this is for battery storage. Any information would be greatly appreciated.
