[Massplanners] abandonment of roadway with complications

I'm not an attorney but my understanding is that with most municipal roads
the municipality only "owns" a right of way. This right of way includes the
right for the public to pass and the right to install utilities. When the
municipality discontinues a road it abandons those rights and the property
owner. usually the abutters, regain use of the land unencumbered by that
right to pass and install utilities. The municipality has nothing to sell
as it never "owned" anything other than a right of way. There are
occasional exceptions to this where the municipality owns the land under
the road (owns the fee) but this is rare.Road law is arcane and can depend
on when and how the road was accepted by the municipality. You should seek
advice from your town counsel.
